It is possible that he took full responsibility for the maintenance of the family, raised the children on his own, and purchased property for the family with personal funds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 29 of the Bulgarian Family Code regulates the possibility for this spouse to request a larger share of the total property acquired during the marriage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>When granting parental rights to one spouse<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to Art. 29, para. 1 of the Bulgarian Family Code, upon termination of the matrimonial community of property due to divorce, the court may determine a larger share of the common property of the spouse who is granted the exercise of parental rights in relation to minor children, if this creates special difficulties for him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Item 8 of Resolution of the Plenum of the Supreme Court No. 5\/31.10.1972 advocates the opinion that the court can determine a larger share of the common property of the spouse, who is granted the exercise of parental rights over minor children, as takes into account the particularities of each individual case. It is accepted that in its assessment, the court should be guided by the degree of difficulties that the husband, who is granted the exercise of parental rights, will experience in the upbringing and education of the minor children of the marriage, in view of the number of these children, their age, their health and other condition relevant to this assessment, etc.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The specified mandatory practice was created under the effect of the Family Code of 1968 (repealed) and it did not lose its force under the effect of the Family Code of 1985 (repealed), as well as under the currently effective Family Code, since the provision of Art. 29, para. 1 of the current Family Code Procedure is basically analogous to the provision of Art. 14, para. 4, item 1 of Family Code \/1968\/ repealed and Art. 28, para. 1 Family Code from 1985 (repealed).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In its assessment, the court must be guided by the degree of difficulties that the husband, who is granted the exercise of parental rights, will experience in the upbringing and education of the minor children of the marriage, taking into account the number of these children, their age, their health and other conditions , which is relevant to this judgment, etc. in each individual case, the court should take into account all the facts that occurred even after the filing of the claim, which are relevant to the disputed right.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Movable items intended for raising and raising children<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Logically, the spouse to whom the exercise of parental rights is granted also receives all items related to the upbringing and education of the children. According to para. 2 of Art. 29 of the Bulgarian Family Code, the husband, who is granted the exercise of parental rights in relation to the children who have not reached the age of majority, receives out of his share the movable property intended for their upbringing and education.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose of the legal norm is to support the parent who is granted parental rights in ensuring the upbringing and education of the children, as well as to protect the interests of the children, securing them with the things that served them in the parents' family them or the parents intended for the service of the children. What items are acquired for the service of the children depends on the standard of living and views on education and upbringing of the parents. In this sense, in the application of Art. 29, para. 2 of Family Code fall not only on movable property, which by their nature are intended for use by children \/children's bed, toys, etc.\/, but also on all movable property that spouses have acquired with a view to their use by their children and related to their upbringing and education, regardless of whether the same can in principle also serve the parents or third parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Importance of contribution in determining larger share<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">Upon termination of the property community, the shares of the spouses pursuant to the law \/Art. 28 of Family Code \/ are equal. This rule is based on the legal assumption that each of the spouses has the due behavior in marriage, summarized in the norm of Art. 17 of Family Code, i.e. that everyone has a contribution to the acquisition of the common property under a chosen community regime. The norm of Art. 21, para. 2 of Bulgarian Family Code determines the forms of the contribution - investment of funds, labor in childcare and household work. In general, the law does not require an equal contribution from each of the spouses and does not give priority to any form of contribution. The law, however, gives legal significance to the significantly greater contribution of one spouse in acquiring the property - conjugal property community after divorce or upon termination of civil partnership during the marriage on the basis of Art. 27, para. 2 of Family Code, providing an opportunity for the husband, who has a significantly greater contribution, to file the constitutive claim under Art. 29, para. 3 of Family Code. In assessing the significance of the contribution, all forms of contribution within the marital relationship should be examined. Significance in this hypothesis applies to all its manifestations and means deviation from the usual. By decision No. 136 of 11.07.2016 pursuant to Administrative Order No. 607\/2016 of the Supreme Court of Appeals, 1st district, Decision No. 144 dated 06.12.2019 pursuant to Administrative Order No. 1076\/2019 of the Supreme Court of Appeals, II city o., decision No. 117 of 22.12.2020 according to city d. no. 780\/2020 of the II city o. of the Supreme Court and decision No. 60 of 4.06.2021 of the Supreme Court of Appeals under city order No. 3052\/2020, II city o. it is assumed that when the spouses have the same non-material contribution consisting of putting in labor and working in the household in the absence of children from the marriage, the many times greater income of one of them, in view of the particularities of the specific case, could be decisive in the court's assessment of the significance of the total contribution of this spouse under Art. 29, para. 3 of Family Code, when without these higher incomes the property could not be acquired. This practice should also be applied when, with the same non-material contribution, significantly larger incomes have been realized and the property acquired with them after the children have reached the age of majority.<\/p>","protected":false},"excerpt":{"rendered":"<p>In a divorce, sometimes one spouse believes that it is not right to divide the property equally.
